The Central Registry
for the Collection of Information Concerning the Abuse or
Neglect of a Child is an official repository for
substantiated reports of child abuse or neglect.
“Substantiated report of abuse or neglect” means a report
where credible evidence of abuse has been found in
accordance with criteria established in Nevada Revised
Statutes and the Nevada Administrative Code 432B. These
reports are legally mandated and maintained by the Nevada
Division of Child and Family Services, Central Office, 4126
Technology Way, 1st
Floor, Carson City,
NV 89706. Names of
individuals are checked against names in the central
registry to identify any substantiated perpetrators of
abuse.
During the 2005
Legislative Session,
Senate Bill 296 was
passed to allow
employers under
certain conditions
to request a Child
Abuse and Neglect
check (CANS check)
on prospective
employees. Employer
information is
limited to provision
of the substantiated
status of a report
and is released only
by the Nevada
Division of Child
and Family Services
(NRS 432.100).
Information may be
released to an
employer under the
following
circumstances (NRS
432.100 (3)): |

(a) |
“If the
person
who is
the
subject
of a
background
investigation
by the
employer
provides
written
authorization
for the
release
of the
information;
and |
|
(b) |
Either: |
|
|
|
1. |
The
employer
is
required
by law
to
conduct
the
background
investigation
of the
person
for
employment
purposes;
or |
|
|
2. |
The
person
who is
the
subject
of the
background
investigation
could,
in the
course
of his
employment,
have
regular
and
substantial
contact
with
children
or
regular
and
substantial
contact
with
elderly
persons
who
require
assistance
or care
from
other
persons,
but only
to the
extent
necessary
to
inform
the
employer
whether
the
person
who is
the
subject
of the
background
investigation
has been
found to
have
abused
or
neglected
a
child.” |
